   TO ENTER: To enter the 2008 Nestle® www.VeryBestBaking.com Family reunion sweepstakes online, log on to www.VeryBestBaking.com and complete the official registration form between 12:01:01am ET on 9/1/2008 and 11:59:00 ET 12/31/08 (“Promotion Period”) and sign up as a Very Best Baker and you will be automatically entered. If you are already a Very Best Baker, simply log in and follow the on screen instructions to enter. You must be a current Very Best Baker or eligible to join in order to be entered into the sweepstakes. All entrants must have a valid e-mail address. Entrant can receive up to four (4) bonus entries as outlined below, for a total of five (5) entries per person per email address, regardless of whether more than one person uses the same e-mail address. In case of dispute as to identity of the winner who enters, entry will be declared made by the registered user (meeting eligibility criteria) of the e-mail account, and if a prize is won, it will be awarded to that registered user. Sponsor not responsible for entry submissions received after the deadline, incomplete information, incomplete transmission defaults, computer server failure and/or delayed, garbled or corrupted data. Any attempts by an individual to access the Web site via a bot script or other brute-force attack will result in that IP address becoming ineligible. Sponsor reserves the right to suspend or terminate this Sweepstakes without notice if, in Sponsor’s sole discretion, the Sweepstakes becomes infected or otherwise corrupted. By entering this Sweepstakes, entrants agree to be bound by these Official Rules and the decisions of the judges, D. L. Ryan Companies, Ltd., 50 Danbury Road, Wilton, CT 06897, which shall be final, binding and conclusive on all matters relating to this Sweepstakes. Sweepstakes starts at 12:01:01 a.m. ET on 9/1/08 and ends at 11:59:00 p.m. ET on 12/31/08.
   
   BONUS ENTRIES: Create a Memory Page: To create a memory page, log on or sign up as a Very Best Baker and go to the “Memories” page and follow the instructions to create memory pages marked either public or private. You will receive one (1) sweepstakes entry per person and per e-mail address for each memory page created for a maximum of four (4) bonus entries per person, per email address or per mail in entry.
   
   Memory Page Guidelines:
   
   • Memory page must include one of your family’s favorite recipes using Nestle® baking products. Stories submitted must relate to the memories of that particular recipe. If a photo is used in the memory page, it must relate to the preparation and/or enjoyment of the recipe.
   • Photo entries must not include unsuitable content or be in violation of third party rights including, but not limited to copyright and right of publicity.
   • If a photo is used, you must have written permission from any person that appears in your photo to use their likeness in the photo submission. If such person(s) are under 18, you must have written permission from minors’ parent or legal guardian, or, if you are the parent or legal guardian, you must consent to their appearance in the photo Entry.
   • Each entry must be original, unpublished, the sole property of submitter and not previously submitted in any other promotion.
   • By submitting a Memory Page marked “public”, entrant agrees to allow Nestle the right to use your submission, commercially or non-commercially, without compensation unless prohibited.
   • Entrant agrees that Nestlé may edit and publish/post any public Memory Page or photo. All Public entries and all rights of ownership and publication of the same will become the property of Nestlé and will not be returned.
   
   
2. PRIZES: GRAND PRIZE (1): One Grand Prize winner will receive a family reunion vacation for ten (10) to one (1) of the following cities: New York, Denver, Orlando, Dallas, or Phoenix. Trip includes round trip air travel for ten (10) from major airport closest to each selected guest’s residence to the destination, hotel accommodations of five (5) rooms for three (3) nights/four (4) days, transfers to/from airport, and $5,000 spending cash (ARV: up to $18,000.00). Travel must be completed by 3/31/10. Travel restrictions and black out dates may apply. Expenses not specifically stated are the sole responsibility of the winner. If winner is unable to travel on dates specified and agreed to, prize will be forfeited and another winner may be chosen. If any winner or winner’s chosen guest is less than 200 miles from destination, air travel will not be awarded. No cash substitutions for prizes will be permitted and prizes are non-refundable and non-transferable, except at sole discretion of Sponsor. Sponsor reserves the right to substitute prize of equal or greater value. Federal, state and local taxes, if any, are the sole responsibility of the winner.
   
   
3. WINNER SELECTION: Winner will be selected in a random drawing on or about 1/15/09 from all valid entries received. Winner will be notified via email and/or by mail on or about 1/28/09. Return of any prize or notification as undeliverable will result in disqualification and an alternate winner may be selected. By entering the Sweepstakes, entrants accept and agree to these rules and the decision of the judges, which shall be final. Winner and their travel companions will be required to sign a Winner’s Agreement and Release and return it within fourteen (14) days or prize will be forfeited in its entirety and another winner may be selected. If travel companion is a minor, parent or legal guardian must accompany minor as one of the travel companion’s. By submitting an entry, a winner agrees to allow use of his or her name, likeness and/or biographical information for promotional purposes (including posting on this Web site), except where prohibited.
   
   
4. ELIGIBILITY: Sweepstakes open only to legal residents of the 50 United States and the District of Columbia 18 years of age or older except employees and the families of Nestlé USA, their affiliates, subsidiaries, and agencies. Nestlé USA their affiliated companies, representatives, agents or employees are not responsible for, and shall be indemnified by the prize winner against, any claims, injuries, losses or damages of any kind resulting from acceptance, use, misuse, possession, or loss of the prize. Subject to all federal, state and local laws. Void where prohibited or restricted by law. No purchase necessary.
   
   
5. OTHER CONDITIONS: Sponsor assumes no responsibility for computer system, phone line, hardware, software or program malfunctions or other errors, failures of any kinds, delayed computer transmissions or network connections that are human or technical in nature. Sponsor assumes no responsibility for any injury, loss or damage to entrants’ or to any other person’s computer relating to, or resulting from, entering or downloading any information or software in connection with this Sweepstakes. Sponsor reserves the right in its sole discretion to cancel or suspend this sweepstakes, in its entirety or in part should virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the sweepstakes. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the sweepstakes by technical or human errors which may occur in the processing of the entries in the sweepstakes. Sponsor reserves the right to withdraw the transmission of this sweepstakes at any time and award the Prize from among eligible entries received prior to the date of the withdrawal. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the game or web-site or to be acting in violation of the Rules. Proof of entry submission does not equate to proof of receipt. All entries become the exclusive property of the Sponsor and will not be returned or acknowledged.
   
   
6. RELEASE OF LIABILITY & PUBLICITY: Entrant agrees that by submitting a photo or memory page, Sponsor, or its designated affiliates, has the right to use Entrant’s photo in whole or in part, commercially or non-commercially, in any media known or unknown, in perpetuity, worldwide, including the right to publish and display the photo Entry for advertising and publicity purposes, as well as to edit and make derivative works, all without additional review or compensation. Additionally, you agree that Sponsor may post your entry (including your and your family’s name and last initial) on its website(s) and their web pages on third party sites.
