CONTEST IS OPEN TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO U.S. LAW. DO NOT ENTER THIS CONTEST IF YOU ARE NOT LOCATED IN THE 50 UNITED STATES OR DISTRICT OF COLUMBIA.

1) TO ENTER:
To enter the 2009 Nestlé® www.TollHouse.com Bake Some Love sweepstakes online, go to www.TollHouse.com and complete the official registration form between 12:01 am ET on 10/5/2009 and 11:59 pm ET 12/31/09 ( the “Promotion Period”) and sign up as a Very Best Baker and you will be automatically entered. If you are already a Very Best Baker, simply log in during that time period and follow the on screen instructions to enter automatically. You must be a Very Best Baker to be entered into the sweepstakes. All entrants must have a valid e-mail address. In addition to one (1) automatic entry, entrant can receive up to nine (9) bonus entries as outlined below, for a total of ten (10) entries per person per email address, regardless of whether more than one person uses the same e-mail address. In case of dispute as to identity of the winner who enters, entry will be declared made by the registered user (meeting eligibility criteria) of the e-mail account, and if a prize is won, it will be awarded to that registered user. Each bonus entry must meet the requirements provided below in ‘Story Guidelines', and be submitted separately. Contest ends and entries must be received by 11:59 pm ET 12/31/09. Sponsor's computer clock governs the time stamp of all entries. Sponsor assumes no responsibility for computer system, phone line, hardware, software or program malfunctions or other errors, failures of any kinds, delayed computer transmissions or network connections that are human or technical in nature.
A) BONUS ENTRIES:
1. Submit a Story: To submit a story for a bonus entry (“Story Entry” or “Story Entries”), go to www.TollHouse.com. Click on the Baking Stories tab and follow the instructions to submit your story. You will need to be registered as a Very Best Baker and registered for the sweepstakes in order to receive a bonus entry for submitting your story. Registration for Very Best Baking is available at the time of sweepstakes registration. You will receive one (1) sweepstakes entry per person and per e-mail address for each Story Entry, for a maximum of nine (9) bonus entries per person, per email address.
Story Guidelines:
- Story Entries submitted must be between 10 and 250 words long, and must be stories of baking, enjoying, preparing or giving favorite NESTLÉ® TOLL HOUSE® baking recipes. You may include a photo, as long as you follow the guidelines below regarding photos and it is used only as an illustration to the Story Entry. Photos with no story will not qualify as an eligible entry.
- Each Story Entry must be original, unpublished, the sole property of submitter and not previously submitted in any other promotion.
- Each story must be unique – you may not re-submit the same story.
- By submitting a story, entrant agrees to allow Nestlé the right to use your submission, commercially or non-commercially, without compensation unless prohibited. This includes possible use of the Story Entry – whether it becomes a winner or not - in NESTLÉ TOLL HOUSE advertising or promotions, including but not limited to print and Internet (may include not only Nestlé sites but other Internet sites and social networking sites, such as Facebook or Twitter, such use at Nestlé’s sole discretion). Entrant agrees and understands that Nestlé may edit their Story Entry in any way or re-enact it using actors, at its sole discretion (see Section 6, below).
- Entrant agrees that Nestlé may edit and publish/post any Story Entry. All Story Entries and all rights of ownership and publication of the same will become the property of Nestlé and will not be returned.
- Photos submitted with stories must act only as support or illustration for the story. They must not include unsuitable content or be in violation of third party rights including, but not limited to copyright and right of publicity (this includes but is not limited to logos from other companies – whether it be on a t-shirt or on a package). You must have written permission from any person that appears in your photo to use their likeness in the photo submission. If such person(s) are under 18, you must have written permission from minors’ parent or legal guardian, or, if you are the parent or legal guardian, you must consent to their appearance in the photo. And, of course, the photo must relate to the preparation, giving, and/or enjoyment of the TOLL HOUSE recipe.
2) PRIZES: GRAND PRIZE: One (1) Grand Prize winner will receive a two (2) night stay for a family of four (4) at any Great Wolf Lodge® property in a themed or premium suite within the United States. Grand Prize includes round trip airfare, transfers to and from airport and hotel, run of house lodging accommodations, one (1) breakfast per family member at the Great Wolf Lodge® property at which you are staying (up to $100.00), and 250 (two hundred fifty) game tokens per family. (ARV: up to $2,500). Travel must be completed by 12/31/10. Travel restrictions and black out dates may apply. Expenses not specifically stated are the sole responsibility of the winner. If winner is unable to travel on dates specified and agreed to, prize will be forfeited and another winner may be chosen. If any winner is less than 200 miles from destination, air travel will not be awarded.
FIRST PRIZE: Five (5) First Prize winners will receive one (1) complimentary night at any Great Wolf Lodge® in the United States (excluding Sandusky, OH). Black out dates may apply. Travel and other expenses not included. Prize must be used by 7/31/10 (ARV: $200 each, Total ARV: $1,000).
3) WINNER SELECTION: Winners will be selected in a random drawing from all eligible entries on or about 2/15/10. Odds of winning depend on number of eligible entries received. Winner will be notified via email and/or by regular mail on or about 2/28/10. By entering the Sweepstakes, entrants accept and agree to these rules and the decision of the judges, which shall be final. Winners will be required to sign a Winner's Agreement and Release and return it by date specified in notification or prize will be forfeited in its entirety and another winner may be selected. Return of any prize or notification as undeliverable will result in disqualification and an alternate winner may be selected. By submitting an entry, a winner agrees to allow use of his or her name, likeness and/or biographical information for promotional purposes (including posting on this Web site), except where prohibited.
4) ELIGIBILITY: Sweepstakes open only to legal residents of the 50 United States and the District of Columbia 18 years of age or older except employees and the families of Nestlé USA, their affiliates, subsidiaries, and agencies. Nestlé USA their affiliated companies, representatives, agents or employees are not responsible for, and shall be indemnified by the prize winner against, any claims, injuries, losses or damages of any kind resulting from acceptance, use, misuse, possession, or loss of the prize. Subject to all federal, state and local laws. Void where prohibited or restricted by law. No purchase necessary.
5) OTHER CONDITIONS: Sponsor assumes no responsibility for computer system, phone line, hardware, software or program malfunctions or other errors, failures of any kinds, delayed computer transmissions or network connections that are human or technical in nature. Sponsor reserves the right in its sole discretion to cancel or suspend this sweepstakes, in its entirety or in part should virus, bug, tampering, unauthorized intervention, fraud, technical failures, or other causes beyond Sponsor's control corrupt the administration, security, fairness, integrity or proper play of the sweepstakes. Sponsor is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by any of the equipment or programming associated with or utilized in the sweepstakes by an technical or human errors which may occur in the processing of the entries in the sweepstakes. Sponsor reserves the right to withdraw the transmission of this sweepstakes at any time and award the Prize from among eligible entries received prior to the date of the withdrawal. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the game or web-site or to be acting in violation of the Rules. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND WILL RESULT IN DISQUALIFICATION FROM PARTICIPATION IN THE CONTEST. SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY FEES) TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.
6) RELEASE OF LIABILITY & PUBLICITY: Entrant agrees that by submitting a photo or a story, Sponsor, or its designated affiliates, has the right to use Entrant's photo in whole or in part, commercially or non-commercially, in any media known or unknown, in perpetuity, worldwide, including the right to publish and display the photo Entry for advertising and publicity purposes, as well as to edit and make derivative works, all without additional review or compensation. Additionally, you agree that Sponsor may post your entry (including your and your family's name and last initial) on its website(s) and their web pages on third party sites. All entrants release Sponsor, and each of its parents, affiliates, subsidiaries, officers, directors, shareholders, agents, employees, and all others associated with the development and execution of this Sweepstakes, from any and all liability with respect to, or in any way arising from, this Sweepstakes and/or acceptance or use of the prize, including liability for personal injury, damages, death or monetary loss. Sponsor assumes no responsibility for any injury, loss or damage to entrants' or to any other person's computer relating to, or resulting from, entering or downloading any information or software in connection with this Sweepstakes. Sponsor and its agents are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user, or by any of the equipment or programming associated with or utilized in this Sweepstakes, or by any human or other errors that may occur in connection with this Sweepstakes.
7) WINNER: Winner's name will be posted on VeryBestBaking.com on or about 3/15/10.
